TERMS AND CONDITIONS
By creating a new customer account with the Municipality of
Central Manitoulin, you agree to the following terms and conditions:
The Terms and Conditions for Use of the Municipality of
Central Manitoulin apply to all use of facilities and lands owned or operated
by the Municipality of Central Manitoulin (the "Municipality"),
regardless of whether the purchase of admission, rental , or other compensation
for use of the Facility (such as participation in a sports league) is
necessary. In consideration for the use of the Properties, the individual,
group, or organization renting facilities or accessing programs and, when
applicable, their members, employees, guests, participants, and agents
(collectively, the "User"), agrees as follows.

The User shall only use Properties for the
agreed upon purpose and shall notify the Municipality of any activities that
would be outside of typical venue usage.

The User agrees to abide by all Municipality of
Central Manitoulin rules and policies posted in the Properties and comply with
any instructions from Municipal staff with regards to the use of such
Properties.

The User Further Agrees:

Activities deemed unsafe, or behavior deemed
inappropriate by the Municipality will be discontinued immediately and the User
will surrender the premise upon demand of the Municipality.
·
Private commercial activity is prohibited within
the Property, without prior approval. This includes but is not limited to
personal training and other sales of goods and services. Violation of this rule
may result in removal from the Property and repeated violations may result in
revocation of the User’s rental fees without a refund.
·
To collect and remove all trash, litter, debris,
etc. from the rental area assigned or used following each use.
·
Not to use any Property if there is a danger
that the surface will be damaged by playing on or after bad weather or other
conditions have affected the surface. Removal of snow is prohibited.
·
The Municipality reserves the right to employ
security measures as the Municipality deems appropriate, at the User's expense.
·
The Municipality is not responsible for any
belongings of people using the Property. Any personal property left on premises
by the User shall, after a period of 14 days, be deemed abandoned and become
the property of the Municipality. The Municipality shall not be liable for any
loss or damage to such property.
·
Failure to comply with any of the requirements
set forth in these Terms and Conditions may result in being prohibited from use
of any Municipal Facilities or Properties in the future.
1. Account Creation
To create an account, you must provide accurate, current,
and complete information during the registration process.
You are responsible for maintaining the confidentiality of
your account information, including your password, and for all activities that
occur under your account. For family accounts, only individuals residing in the
household can be listed on your account.
2. Refund Policy
Programs
All participant program cancellation requests must be
received in writing a minimum of fourteen (14) days prior to the start of the
program to receive a full refund.
Written cancelation requests between seven (7) and thirteen (13) days
prior will be eligible for a fifty percent refund. No refunds will be given
with less than seven (7) days’ notice.
Fees will not be prorated for registering after a program has
begun. Full refunds are issued if the
Municipality of Central Manitoulin cancels a program. No refunds or credits are
issued for individual missed classes. To request a cancellation, please email parksandrec@centralmanitoulin.ca.
NOTE: Cancellations by a participant due to weather are not
subject to a refund.
Facility Reservations
All reservation cancellations must be made by request to the
Municipality of Central Manitoulin office in writing or in person by 4:30 pm at
least fourteen (14) days prior to the scheduled event to receive a full
refund. Written cancelation requests
between seven (7) and thirteen (13) days prior will be eligible for a fifty
percent refund. No refunds will be given with less than seven (7) days’ notice.
Full refunds are issued if the Municipality of Central Manitoulin cancels a
reservation. To request a cancellation, please email parksandrec@centralmanitoulin.ca.
NOTE: Cancellations by participants due to weather are not
subject to a refund.
3. Non-Refundable Items
The following items are non-refundable:
Recreation Programs, such as individual missed yoga or
exercise classes
Drop in Programs
Credit card service fees, if any
4. Security and
Safety
The User shall not allow any illegal substances to be
consumed on Municipal property or in Municipal facilities. Alcoholic beverages are not permitted on
Municipal property unless the User has received prior Municipal consent and has
provided the Municipality with a copy of their liquor licence prior to their
booking as set out in their facility agreement. The User shall obey all
applicable Provincial laws, rules, and regulations with regard to smoking,
vaping and alcohol consumption on public property.
The User shall use only designated public parking areas,
unless specifically authorized by the Municipality.
The User shall not alter, add, remove from, or improve the
Facilities, without the prior written consent of the Municipality.
The User shall notify the Maintenance Department as soon as
possible of any damage, vandalism, needed repairs and/or safety issues. If
damage is the result of User's negligence or failure to comply with accepted
operational rules and regulations, the User may be held responsible for
reimbursing the Municipality for all or part of the repair costs to be deducted
from the security deposit.
The User must enter and exit from the main entry points
during normal hours of operation.
It is strictly prohibited to prop open doors, or use doors
for entering and exiting, unless authorized or in an emergency situation.
If the User does not follow the rules or requirements of
this these Terms and Conditions, the User may be subject to removal from the
Property. If deemed necessary, the Municipality reserves the right to require a
meeting with any violator prior to them being considered for reinstatement.
If a user’s representative has repeatedly violated any of
the above requirements, they may not be allowed to return to any Municipal
Recreation Property. Repeated violations of Terms and Conditions may result in
termination of the User's rental agreement or other privileges to utilize Municipal
facilities.
5. Photograph
Policy
For
promotional purposes, we may photograph our activities and participants. Photos
may be used in flyers, brochures, our website, or on social media. If you do
not wish to have your or your child's photo taken, please notify the office at
the time of registration by emailing admin@centralmanitoulin.ca.
6. Non-Discrimination Policy
The Municipality of Central Manitoulin does not discriminate
on the basis of race, color, gender, national origin, religion, age, sexual
orientation, gender identity, disability, or any other status protected by
applicable federal, state or local law in the provision of services.
7. Modification of Terms
The Municipality of Central Manitoulin reserves the right to
modify these Terms and Conditions at any time. Any changes will be effective
immediately upon posting on our website. Your continued use of your account
constitutes acceptance of any modified terms.
